A. Customer information on the conclusion of distance contracts

 

The following information serves to fulfill our legal obligation to provide information in the case of distance contracts and electronic commerce.

You will receive all information in text form at the latest upon delivery of the goods. You can also print this information or save it to your hard drive.

 

1. Identity of the supplier

2. Conclusion of contract

 

(1) You can select products from the assortment and collect them in a so-called shopping cart by clicking the "Add to cart“ button. Alternatively, you can also initiate the order of a single product directly via the "PayPal Express“ button.

 

By clicking on the "buy“ button, you are making a binding offer to us to purchase the goods in the shopping cart. Before submitting the order, you can change and view the data at any time. We will then send the customer an automatic order confirmation by e-mail, in which the order is listed and which can be printed via the „Print“ function. The order confirmation itself does not represent a binding acceptance of the order.

 

Rather, the purchase contract is concluded

 

  1. a) with the sending of a separate e-mail with an order confirmation or
  2. b) with the delivery of the goods or
  3. c) when you are asked to pay by the seller after his order,

 

in the event of the occurrence of several alternatives, the earlier one shall be decisive for the conclusion of the agreement.

 

(2) The contract text will be stored by us and sent to you together with the legally effective included general terms and conditions by e-mail after conclusion of the contract.

3. Delivery and delivery reservation

 

(1) The delivery period for deliveries within Germany is indicated on the respective offer page. The start of the delivery period is determined (depending on the selected payment method) according to paragraphs 2 to 4.

 

(2)The delivery period starts one day after you have sent us the credit card data generated by VIMpay for the ordered hardware (ring or other contactless wearable) (see § 2 of the GTC).

 

(3) For deliveries outside Germany, the delivery times stated in the overview "Shipping“ apply.

 

(4) If the start or end of the deadline falls on a Saturday, Sunday or a public holiday, the start or end of the deadline shall be postponed to the following working day.

 

(5) The shipment is made exclusively to the countries indicated in the overview "Shipping“ and under the restrictions or delivery methods indicated in the overview "Shipping .

 

(6) The delivery is subject to proper self-delivery.

4. Purchase price and shipping costs

 

(1) The stated prices are total prices in euros and include the statutory sales tax. Temporary special offers or discounts are shown as such in the context of the presentation of the individual goods on our website.

 

(2)We charge our delivery and shipping costs in addition to the stated total prices of the respective goods. The respective shipping costs can be found in the overview "Shipping.

 

(3) Otherwise, you will not incur any additional costs when ordering by using the means of distance communication.

6. Right of cancellation for consumers and sample cancellation form

a) Right of cancellation for consumers for distance contracts/contracts concluded in online stores

 

Consumers - i.e. any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his or her commercial nor to his or her independent professional activity - may cancel their contractual declaration in the case of contracts against payment under the following conditions:

 

 

In the case of a contract for one or more goods capable of being sent by parcel post, which reach the consumer in a single delivery, which are delivered separately or which are delivered to the consumer in several partial consignments or pieces:

You have the right to cancel this contract within fourteen days without giving any reason.

 

The cancellation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the last goods.

 

In order to exercise your right of cancellation, you must inform us (PAGOPACE GmbH, trading as PAGOPACE, Neumarkt 36-38, 50667 Cologne, e-mail: kontakt@pagopace.de) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to cancel this contract. You can

use the attached sample cancellation form for this purpose, which is, however, not mandatory.

 

To comply with the cancellation period, it is sufficient that you send the notification of the exercise of the right of cancellation before the expiry of the cancellation period.

 

Consequences of the cancellation

 

If you cancel this contract, we will reimburse you for all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your cancellation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged for this repayment.

 

We may refuse to refund you until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

 

You must return or hand over the goods to us immediately and in any case no later than within fourteen days from the day on which you notify us of the cancellation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days.

 

You bear the direct costs of returning the goods.

 

You only have to pay for any loss of value of the goods if this loss of value is due to the handling of the goods which is not necessary for the inspection of the condition, properties and functioning of the goods.

 

 

Exclusion of the right of cancellation

 

The right of cancellation is excluded for contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer,

7. Warranty conditions

 

The customer is entitled to a statutory warranty right, which is modified according to §§ 8, 9 of theGTC.

8. Note on the Electrical and Electronic Equipment Act

 

Old devices containing harmful substances is marked with the symbol of a crossed-out trash can, similar to the symbol in the illustration:

 

 

Old devices of the same type that essentially fulfill the same functions as the new device must be taken back by us free of charge when we sell a new electrical or electronic device to an end user.

 

We are obliged to take back free of charge old devices that are not larger than 25 centimeters in any external dimension in quantities customary for households; the take-back is not linked to the purchase of an electrical or electronic device from us.

 

You can return these devices to us free of charge by sending them back to us by mail:

If you would like us to take back an old device from you, please send us an e-mail with your request to kontakt@pagopace.de. Upon receipt of your e-mail, we will send you instructions for the return, etc. Of course, you can still return an old device to one of the municipal collection points, which is also possible free of charge for end consumers.

 

The disposal of old devices containing harmful substances in household waste is expressly prohibited!

 

Before handing over the equipment, batteries or accumulators are to be removed, if this is possible. Batteries and accumulators must be removed in such a way that they are not damaged and can be identified after removal. Old devices often contain sensitive personal data. This applies in particular to information and telecommunications technology devices such as computers and smartphones. In your own interest, please note that each end user is responsible for deleting the data on the old devices to be disposed of.

 

 

 

B. Further customer information on the electronic conclusion of contracts

1. How does the online contracting with us work?

 

If you have found a product in our webshop that meets your requirements, you can add it to the shopping cart by clicking the "Add to cart" button. Alternatively, you can also initiate the ordering process immediately by pressing the "PayPal" button.

 

a) Order by PayPal Express

By pressing the button "PayPal Express“ you will be taken to a page where you can log in to your PayPal account.

On the following page you will see the goods you have selected and the delivery address you have saved. Please select here still the shipping method by clicking on it. Then click on the button "Next".

This will take you back to our online store. Here you get an overview of the information provided. Furthermore, you can view our cancellation policy, our privacy policy and our general terms and conditions. Please read them carefully and confirm that you accept the GTC by ticking the corresponding box. Only when you confirm that you have taken note of the right of cancellation and accept the validity of the general terms and conditions, you can continue the order.

We will confirm receipt of your order immediately. The purchase contract is concluded with payment by PayPal Express with payment instruction by the customer.

b) Order via shopping cart

Once you have placed products in the shopping cart, the products in the shopping cart will be displayed on the right side of the page under the heading "Shopping Cart". Clicking on one of the displayed products will take you to the aforementioned shopping cart overview. There you can remove products from the shopping cart or change their quantity.

By pressing the button "Checkout“ you can immediately initiate the ordering process with regard to the items in the shopping cart.

After pressing the button "Checkout“ a page opens where you can either activate your customer data already created with us or register as a new customer with us. However, you can also order as a guest without creating a customer account.

Non-registered customers must enter their address data, data for communication with them and an e-mail address at this point. If you wish to create a user account, you must also enter a password of your choice. You can then order in the future without having to enter your address data again.

In the next two steps you can select the shipping method and the payment method.

In the next step you will find an overview, which will show you the details of your order.

Furthermore, you can view at this point our cancellation policy, our privacy policy and our terms and conditions.

Read them carefully and then confirm that you accept the terms and conditions by placing a check mark in the appropriate input field. Only when you confirm that you have noted the right of cancellation and accept the validity of the terms and conditions, you can continue the order.

Please check all information carefully. You can edit data entered during the ordering process directly on this page or via the "Back" function of your internet browser.

If all the information is correct, click on "Order with obligation to pay" to complete the entire ordering process.

2. storage of the contract text and access for the customer

We store your order data and send them to you in the access confirmation by e-mail. You will receive our GTC by e-mail at the latest after conclusion of the contract.

 

3. Input error

 

You can correct your entries at any time during the ordering process by using the "Back“ button in your browser, which is marked with a green arrow pointing to the left, and then making the corresponding change. You can change the desired number of items by changing the number in the"Quantity“ field in the shopping cart. You can change or correct the shipping address, the billing address and the products in the shopping cart, if necessary, by clicking on the button "change“ in the respective area of the order overview. Furthermore, you can edit the data entered during the ordering process via the „Back“-function of your Internet browser.

 

By closing the Internet browser, you can cancel the entire ordering process at any time.

You have the possibility to conclude contracts with us in German language.
